1. Acceptance of the Terms and Conditions

The customer acknowledges having read, at the time of placing the order, the specific terms and conditions of sale set forth on this screen and expressly declares that they accept them without reservation. These General Terms and Conditions of Sale govern the contractual relationship between jakin-boaz and its customer, both parties accepting them without reservation. These General Terms and Conditions of Sale shall prevail over any other terms and conditions contained in any other document, unless there is a prior, express, and written waiver.

2. Products

The photographs illustrating the products are not contractually binding. If any errors are found in them, EURL Jakin-Boaz shall not be held liable under any circumstances. The majority of the products offered to customers by the store are available in our warehouse.

3. Order

Automatic order confirmation systems are considered proof of the nature, content, and date of the order. jakin-boaz will confirm acceptance of the order to the customer at the email address provided by the customer. The sale will not be finalized until the order is confirmed. jakin-boaz reserves the right to cancel any order from a customer with whom there is a dispute regarding payment for a previous order. The information provided by the buyer when placing the order is binding: in the event of an error in the recipient’s contact information, the seller shall not be held liable for any inability to deliver the product.

4. Delivery

After payment for the order has been received, jakin-boaz agrees to deliver all items ordered by the buyer to its carrier within a maximum of 7 business days. This carrier is contractually obligated to jakin-boaz to deliver the order to the buyer’s provided address. In the case of cash-on-delivery shipping, the customer agrees to pay the carrier or its representative the full amount indicated at the time of order confirmation. Furthermore, for deliveries outside of mainland France, the customer agrees to pay all taxes due upon importation of the products, including customs duties, value-added tax, and any other taxes required under the laws of the country receiving the order. All orders placed with jakin-boaz are intended for the customers’ personal use; customers or recipients of the products are prohibited from reselling the products, either in part or in full. Delivery will be made by La Poste or Chronopost, depending on the customer’s choice of shipping method within mainland France. Delivery is made within the time slot agreed upon with the customer by handing the product directly to the designated recipient or, in the event of absence, to another person authorized by the customer. Any delays do not entitle the buyer to claim damages. Deliveries to EEC countries are made by La Poste via Colissimo Suivi Europe or Chronopost, depending on the customer’s choice; for deliveries outside the EEC, shipments are made via international postal services or Chronopost, depending on the customer’s choice. In the case of a technical product, the customer must take particular care to verify that the delivered device is functioning properly and to read the user manual provided. In the event of apparent defects, the buyer has the right to return the item under the conditions set forth in this document. The following are considered force majeure events that release the seller from its obligation to deliver: war, riots, fire, strikes, accidents, and the inability to obtain supplies. Goods are always shipped at the recipient’s risk. Always inspect your package upon arrival. You have 48 hours to file any claims with the carrier in the event of missing items or damage. For availability reasons, an order may be delivered to the customer in multiple shipments. The customer is then charged for only one delivery. If the customer wishes to have two delivery locations, they must place two separate orders, each with the associated delivery charges.

5. Right of Withdrawal

You have 10 days (from the date you receive the items) to decide whether you want to keep them. If you wish to exchange or return the item(s), please send them back in their original, undamaged packaging, along with any accessories, instructions, and documentation to the following address: jakin-boaz, Lot Saint Pierre, 84100 Orange. If you exercise your right of withdrawal, jakin-boaz is required to refund the amounts paid by the customer, free of charge except for shipping costs, excluding return shipping costs. The refund is due within a maximum of 30 days.

6. Price

Prices are listed in euros. The price shown on the product pages does not include shipping. The price shown in the order confirmation is the final price, which includes all taxes and VAT for France and other EU countries. This price includes the cost of the products, handling, packaging, and storage fees, as well as shipping and setup costs.

7. Payment

The price charged to the customer is the price indicated on the order confirmation sent by jakin-boaz. The price of the products is payable in full on the day the order is placed. Payment is made by credit card bearing the CB logo. Online, [NAME OF SECURE PAYMENT SYSTEM] allows you to pay via a banking server operated by [NAME OF YOUR BANK] in a secure environment. Your credit card number is therefore directed to the bank’s servers; your payment is made directly to the bank in a secure environment without passing through the store’s server—a guarantee made all the more important by the fact that your card details are known only to our banking partner, the Marseille-based credit company. An order confirmed by the customer will only be considered final once the relevant banking payment centers have given their approval. In the event of refusal by said centers, the order will be automatically canceled and the customer notified by email. Furthermore, jakin-boaz reserves the right to refuse any order from a customer with whom there is an outstanding dispute.

8. Disputes

This contract is governed by French law. jakin-boaz shall not be held liable for any damages of any kind, whether material, immaterial, or physical, that may result from the malfunction or misuse of the products sold. The same applies to any modifications to the products made by the manufacturers. In any event, jakin-boaz’s liability shall be limited to the amount of the order and shall not be invoked for simple errors or omissions that may have remained despite all precautions taken in the presentation of the products. In the event of difficulties in the performance of this contract, the buyer has the option, prior to any legal action, to seek an amicable resolution, particularly with the assistance of: a professional association in the industry, a consumer association, or any other advisor of their choice. It is noted that the search for an amicable solution does not interrupt the “short period” of the statutory warranty, nor the duration of the contractual warranty. It is noted that, as a general rule and subject to the courts’ discretion, compliance with the provisions of this contract regarding the contractual warranty requires that the buyer fulfill their financial obligations to the seller. Complaints or disputes will always be received with attentive consideration, as good faith is always presumed in those who take the trouble to explain their situation. In the event of a dispute, the customer shall first contact the company to seek an amicable resolution. Failing that, the Commercial Court of Carpentras shall have exclusive jurisdiction, regardless of the place of delivery and the accepted method of payment.

9. Warranty

In any case, jakin-boaz cannot be held liable for non-compliance with the regulatory and legislative provisions in force in the country of delivery; jakin-boaz’s liability is strictly limited to the value of the product in question, as of the date of sale, and there is no right of recourse against the brand or the manufacturer of the product. In any event, the customer is entitled to the legal warranty against title defects and hidden defects (Art. 1625 et seq. of the Civil Code). Provided that the buyer proves the existence of the hidden defect, the seller is legally required to remedy all consequences thereof (Art. 1641 et seq. of the Civil Code); if the buyer brings the matter before the courts, they must do so within a “short period” from the discovery of the hidden defect (Art. 1648 of the Civil Code). 10. Legal Information
